Judge Joshua D. Wolson of the US District Court for the Eastern District of Pennsylvania has ruled that Rivers Casino Philadelphia must proceed with a class action lawsuit. The legal action stems from a cyberattack that occurred in January, during which customers allege an unauthorized party accessed files on the casino’s servers.
The lawsuit centers on the security of sensitive customer information, including names, Social Security numbers, and bank account details. Plaintiffs argue that the casino failed to implement sufficient safeguards, potentially violating consumer protection and privacy laws. They further contend that the operator did not fully disclose the scope of the incident after notifying affected individuals.
Legal Ruling and Dismissed Claims
Judge Wolson determined that the casino had a duty to exercise reasonable care in protecting user data. The court found that the plaintiffs plausibly alleged a failure to meet this obligation, citing reports of increased fraudulent activity attempts following the breach. Consequently, the judge denied the casino's motions to dismiss the negligence claim.
Despite the ruling on negligence, the court dismissed several other allegations. These included claims for breach of contract, unjust enrichment, invasion of privacy, and breach of confidence. The judge concluded that the plaintiffs did not provide sufficient grounds to support these specific accusations.
